These terms govern your access to SeniorIndex.ai, the IndexIQ terminal, and the reports, publications, and data we produce. Please read them carefully before purchasing. By using the Service, you agree to these terms.
By accessing or using any part of the Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms, and "you" refers to both you and the organization.
SeniorIndex publishes independent market intelligence on the U.S. senior care industry, including skilled nursing facilities and home health agencies. The Service includes:
We may add, remove, or change any feature of the Service at any time.
You must be at least 18 years old and capable of forming a binding contract. IndexIQ accounts use magic-link authentication — you are responsible for maintaining the security of the email address associated with your account, for all activity under your account, and for notifying us promptly of any unauthorized access.
Prices are listed in U.S. dollars and are exclusive of any applicable taxes. We accept payment via Stripe; by purchasing, you authorize us (through Stripe) to charge your payment method for the amount shown at checkout. Prices may change at any time, but changes will not affect purchases already completed.
Report purchases are one-time transactions. Reports are delivered by email and by the success page immediately following successful payment, typically within minutes.
IndexIQ credit bundles are one-time purchases. Credits do not expire. Credits have no cash value, cannot be transferred between accounts, and cannot be redeemed for cash.
All sales are final. Contact support at inquiries@seniorindex.ai for disputes.
Because reports and credits are digital products delivered on purchase, we do not offer refunds or cancellations as a matter of policy. If you believe a purchase was made in error, a report failed to deliver, or there is a billing dispute, email us and we will review your request in good faith on a case-by-case basis.
Subject to your compliance with these terms, SeniorIndex grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the reports and content you purchase for your internal business use — including internal diligence, internal decision memos, and sharing within your own organization.
You may quote short excerpts (fewer than 200 words) in external materials with attribution to "SeniorIndex.ai." Use of charts or tables in external presentations is permitted with visible attribution.

The underlying facility-level data in our reports originates from public sources — principally the Centers for Medicare & Medicaid Services (CMS), HCRIS cost reports, Payroll-Based Journal (PBJ) submissions, the U.S. Census Bureau, and state regulatory agencies. That underlying data is not proprietary to SeniorIndex.
The following are the proprietary property of SeniorIndex: our report layouts and editorial structure, our aggregated tables and cross-table joins, our computed metrics and scores (including the SeniorIndex Stability Score, SeniorIndex Need Score, SeniorIndex Agency Score, and any other named score), our written analysis and commentary, our methodology descriptions, and all trademarks including "SeniorIndex," "IndexIQ," "The SeniorIndex Brief," and the SeniorIndex wordmark. These are protected by copyright and trademark law. All rights not expressly granted are reserved.
SeniorIndex is a research publisher, not a licensed advisor. Our reports describe and interpret publicly available data. We do not provide investment advice, legal advice, tax advice, accounting advice, or medical advice. Nothing in our reports constitutes a recommendation to buy, sell, or hold any security or asset, or to enter into any transaction.
We source our underlying data from government-published records that are known to contain errors, omissions, and reporting lags. We make reasonable efforts to deliver data refreshed from primary sources on a documented cadence, but we do not warrant that any data point is complete, current, or free of error. Users making material decisions — investment, acquisition, lending, employment, or clinical — are solely responsible for independently verifying any fact they rely on.
THE SERVICE AND ALL REPORTS, DATA, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SENIORINDEX DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, SENIORINDEX AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR INVESTMENT LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SENIORINDEX IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless SeniorIndex and its owners, employees, and contractors from any third-party claim, demand, loss, or expense (including reasonable attorney fees) arising out of (a) your violation of these terms, (b) your misuse of the Service or content, or (c) your violation of any law or third-party right.
We may suspend or terminate your access to the Service at any time for violation of these terms, for non-payment, or to comply with legal process. You may stop using the Service at any time. Sections that by their nature should survive termination will survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.
Before filing a formal dispute, you agree to first contact us at inquiries@seniorindex.ai and attempt to resolve the matter informally for at least thirty (30) days.
We may update these terms from time to time. Material changes will be announced via email to IndexIQ account holders and active subscribers, and the "Effective" date above will be updated. Continued use of the Service after a change constitutes acceptance of the revised terms.
If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the Privacy Policy, constitute the entire agreement between you and SeniorIndex regarding the Service.
